WEBSITE USER AGREEMENT – ROBBO BARCELONA
- ACCEPTANCE OF TERMS
2. DESCRIPTION OF ROBBO BARCELONA SERVICES
Description of ROBBO Barcelona Services: The ROBBO Barcelona website (https://robbo.club/barcelona/), operated by the Operator, provides supplemental science, technology, engineering, and math (STEM) software and training classes for students enrolled in ROBBO Club Barcelona courses. Services include, but are not limited to, curriculum and assessments, analytic tools, personalized content, and programming through the website and in collaboration with third-party services.
You understand and agree that ROBBO Barcelona services may include advertisements and certain communications from the Operator that cannot be opted out of, including but not limited to account activity notifications, service announcements, administrative messages, and newsletters; these communications form part of your ROBBO Barcelona membership.
Unless explicitly stated otherwise, any new features that augment or enhance current ROBBO Barcelona services are subject to the TOS. You understand that ROBBO Barcelona services are provided "AS-IS" and that the Operator assumes no responsibility for timeliness, deletion, or mis-delivery of information or data. You must provide and are responsible for all equipment necessary to access ROBBO Barcelona services.
Most ROBBO Barcelona classes and courses are delivered by independent third parties—including schools, individual teachers, retail stores, and entrepreneurs—who are not under the control of the Operator. The Operator assumes no responsibility for the actions of these third parties, and you agree to hold the Operator harmless for third-party actions in accordance with section 8 of the TOS.
Technical processing and transmission of ROBBO Barcelona services may involve (a) transmissions over various networks and (b) changes to conform and adapt to technical requirements of connecting networks or devices.
3. YOUR REGISTRATION OBLIGATIONS
By using ROBBO Barcelona services, you confirm that you are of legal age to form a binding contract and that you are not prohibited from receiving services under Spanish law or other applicable jurisdiction. You agree to:
a. Provide true, accurate, current, and complete information as prompted by the ROBBO Barcelona registration form ("Registration Data").
b. Maintain and promptly update the Registration Data to keep it accurate and complete.
If you provide false, inaccurate, or incomplete information, or if the Operator has reasonable grounds to suspect such information is false or incomplete, the Operator may suspend or terminate your account and refuse any current or future use of ROBBO Barcelona services.
4. PRIVACY POLICY OF THE OPERATOR
Registration Data and certain other information about you are subject to our privacy policy. By using ROBBO Barcelona, you consent to the collection and use of this information, including storage, processing, and use by the Operator and its affiliates, as described in the applicable privacy policy.
5. CONTRIBUTIONS TO THE OPERATOR
By submitting ideas, suggestions, documents, and/or proposals ("Contributions") to the Operator, you agree that:
a. Contributions do not contain confidential or proprietary information.
b. The Operator has no obligation of confidentiality regarding Contributions.
c. The Operator may use, disclose, or choose not to use Contributions for any purpose worldwide.
d. Contributions automatically become the property of the Operator without obligation to you.
e. You are not entitled to any compensation from the Operator for Contributions.
6. INDEMNITY
You agree to indemnify and hold the Operator, its subsidiaries, affiliates, officers, agents, employees, partners, and licensors harmless from any claim, including reasonable attorneys' fees, arising from content you submit, post, transmit, modify, or otherwise make available through ROBBO Barcelona, your use of services, connection to services, violation of the TOS, or violation of rights of others.
You also agree to indemnify the Operator for disputes or claims against independent third parties, including schools, teachers, retail stores, or entrepreneurs, for their actions or omissions.
7. NO COMMERCIAL REUSE OF ROBBO BARCELONA
You agree not to reproduce, duplicate, copy, sell, trade, resell, or exploit for commercial purposes any portion of ROBBO Barcelona services, including content, curriculum, software, or analytics.
8. GENERAL PRACTICES REGARDING USE AND STORAGE
The Operator may establish general practices and limits for ROBBO Barcelona services, including data retention periods and access frequency limits. The Operator is not responsible for deletion or failure to store content and may log off inactive accounts. Practices and limits may change.
9. MODIFICATIONS OF ROBBO BARCELONA SERVICES
The Operator reserves the right to modify or discontinue ROBBO Barcelona services, temporarily or permanently, with or without notice. You agree that the Operator is not liable for modifications, suspensions, or discontinuances.
10. LINKS
ROBBO Barcelona may provide links to other websites. The Operator is not responsible for external sites, content, or resources. You agree that the Operator is not liable for damages or losses from the use of such content.
11. PROPRIETARY RIGHTS OF THE OPERATOR
ROBBO Barcelona services and software contain proprietary and confidential information protected by intellectual property laws. You agree not to modify, rent, lease, sell, distribute, or create derivative works of services or software. You are granted a personal, non-transferable license to use software on a single device. You may not copy, modify, reverse engineer, or access software in unauthorized ways.
12. DISCLAIMER OF WARRANTIES
Services and software of ROBBO Barcelona are provided "AS-IS" and "AS AVAILABLE." The Operator disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose.
Use of services is at your own risk. The Operator is not responsible for missed classes, software malfunctions, or dissatisfaction with services.
13. LIMITATION OF LIABILITY
You agree that the Operator is not liable for punitive, indirect, incidental, special, consequential, or exemplary damages arising from ROBBO Barcelona services, including data loss, unauthorized access, or third-party actions.
14. EXCLUSIONS AND LIMITATIONS
Some jurisdictions do not allow certain warranty exclusions or liability limitations. These limitations may not apply in such cases.
15. NO THIRD-PARTY BENEFICIARIES
No third-party beneficiaries exist, except as expressly stated in this TOS.
16. NOTICES
The Operator may send notices about TOS changes by email, SMS, or website postings. Unauthorized access may prevent receipt of notices.
17. TRADEMARK INFORMATION
All ROBBO trademarks, names, logos, and brand features are property of ROBBO. You may not use them without prior written permission from the Operator.
18. EMAIL NEWSLETTER
By creating an account, you may be added to the ROBBO Barcelona newsletter for updates on curriculum and events. You can unsubscribe at any time.
19. GENERAL INFORMATION
This TOS constitutes the entire agreement between you and the Operator regarding ROBBO Barcelona services. Additional terms may apply for third-party or affiliate services.
Choice of Law and Forum:
The TOS is governed by Spanish law. All disputes shall be resolved in Spanish courts.
Waiver and Severability:
Failure to enforce provisions does not constitute a waiver. Invalid provisions do not affect the remainder of the TOS.
Non-Transferability and No Survivorship Rights:
Accounts are non-transferable. Upon death, the account may be terminated upon presentation of a death certificate.
Statute of Limitations:
Any claim must be filed within one (1) year of its origin.
